These terms and conditions govern the contract between Eagle Owl Property Ltd(registered office: 1 Victoria Court, Bank Square, Morley, Leeds, West Yorkshire, United Kingdom, LS27 9SE – Registered No: 10100699) or Worthing Stays Limited ( Registered No: 13011243, Registered Office for all: 1 Victoria Court, Bank Square, Morley, Leeds, West Yorkshire, United Kingdom, LS27 9SE) or Abbey House Worthing Limited ( Registered No: 14631353, Registered office address : 1 Victoria Court, Bank Square, Morley, Leeds, West Yorkshire, United Kingdom, LS27 9SE) and you person making the booking including all adult members of your party who will be staying in any of our apartments/houses.Your stay with us is not intended to confer exclusive possession on either the client or guest nor to create the relationship of landlord and tenant between Eagle Owl Property Limited/Worthing Stays Limited/Abbey House Worthing Limited  and either the client or the guest. Neither the client nor the guest will be entitled to any tenancy, or any short assured or assured tenancy, or to any statutory protection under the Housing Act 1988, or to any other statutory security of tenure now or upon the determination of this agreement. Rates are subject to change without notice and VAT is charged as appropriate.

Agreement for Occupation

The managing agent permit the client to occupy the property, such occupation being by the guest personally only and to use the owners’ furniture and effects for the accommodation period. All visitors to the apartment are the responsibility of the guest. You must be 18 years or over when you book your accommodation. Your booking is made as a consumer and you acknowledge that no liability can be accepted for any losses suffered or incurred by you. We reserve the right to refuse to accept any booking for whatever reason. If you want to increase your length of stay then we will do everything possible subject to availability of accommodation to find something suitable for you. It must be borne in mind that this may not always be possible. If the number of people permitted to occupy an apartment is exceeded (which would be in breach of Health and Safety Regulations) we reserve the right to move excess occupants and charge for additional apartments or require the excess occupants to vacate the property.

Check In, Availability & Booking
Check in is between 3pm and 9pm on the day of arrival. If you need to check in outside of these hours, this must be arranged in advance. Apartments must be vacated by 10am on the day of departure unless otherwise agreed in advance. Failure to vacate by this time may result in further charges. Desired availability of accommodation at the rates shown on the website may be limited and/or restricted to certain periods. Our reservations team are available to take your booking Monday – Friday 9.00 am until 5.30pm. You will be asked to secure your booking with either a credit or debit card in addition to a deposit.

Deposit
100% of the total price at booking will be required to secure the booking confirmation. A pre-payment of £500 will be taken to cover any damage made to the property. Any bookings over 4 weeks will be required to pay an agreed amount for a deposit and is returned after checkout and inspection.

Cancellation and Amendments
All cancellations and amendments must be made in writing. A charge will be levied in respect of reservations, which are subsequently cancelled, or in the case of non-arrival. In the case of bookings for the duration of 1 – 14 nights we will require 14 days notice of cancellation in writing prior to the arrival date and for bookings of 15 nights or more 28 days notice of cancellation in writing prior to the arrival date. If the appropriate cancellation notice is not given in writing prior to the proposed arrival date the total cost of the accommodation will be charged, unless we are able to re-let the accommodation at the same rate. We recommend that appropriate insurance is taken out especially for longer stays. Whilst every effort is made to fulfill, your requests, unfortunately we cannot guarantee these and failure to do so will not constitute a breach of contract. In the unlikely event that we have to change or cancel your reservation, we reserve the right to do so. However, you have the right to accept the changed arrangements as notified or cancel your reservation and receive a full refund of monies paid. Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd will be under no further obligation or liability for losses or expenses arising from the cancellation. There are no further circumstances for which Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd will be liable for a refund.

Car Parking
Car parking varies at each property; parking is at the customer’s risk.

Cleaning
Unless otherwise agreed, the property is booked on a self-catering basis. For stays in excess of one week, the price will include a full clean of the apartment including linen and towel change. Please note the weekly clean will not include the washing of dishes or removal of excess rubbish. The apartments are to be left in a clean and tidy manner, failure to do so will result in an additional cleaning charge of £75.00 and this amount will be charged to the credit/debit card provided. We are able to provide extra bed linen and towels by prior arrangement but an additional charge will apply.

Lost Keys
A charge of £75 will be made for any lost keys.

Complaints and Comments
Any complaint or comment regarding your stay should be made to our office. Please kindly note complaints are more easily resolved while you are still in the property. Damages
Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd reserves the right to charge your credit card or invoice you for any theft of or damage caused to property during your stay. We will provide you with full breakdown of such charges which may include an administrative fee to recover our costs.
We also reserve the right to cancel any booking should you or any members of your party create a serious disturbance to any other guests or adjoining neighbours.

General Information
Although every effort has been made to ensure the accuracy of the information provided, we cannot accept responsibility for any errors or omissions, and reserve the right to vary, amend or cancel any of the information should we find such alterations necessary.

Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd cannot be held responsible for events beyond its control or the control of its suppliers (such as fire, strikes, industrial action, technical problems with transport and bad weather), nor for any curtailment, cancellation or change to any accommodation, activity or itinerary, which is caused as a result of such events. Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd excludes all loss of valuables and damage to property and any direct, indirect or consequential losses suffered by you, other than death or personal injury resulting from a negligent act or omission by Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd, its officers or employees. If you have valuable items please discuss this with a member of staff on arrival. Your statutory rights remain unaffected.

Insurance
Guests and visitors are advised to ensure their own insurance covers any loss or damage to personal property during their stay and to ensure adequate personal and travel insurance is taken out.

Occupancy
The apartment is to be occupied only by the persons detailed on the booking form. We reserve the right to charge an additional fee if it is found that there are persons occupying the apartment who are not included on the booking form and reserve the right to ask the entire party to vacate the premises. In these circumstances we also reserve the right to retain the damage deposit and there will be no refund for unused days. In the event of any complaints of noise or disrespect and damage to the property, we reserve the right to require guests to vacate the premises with immediate effect, and with no compensation for unused days. We reserve the right to decline any bookings where we have reason to believe that the customer will not use the apartment responsibly. This could include behaviour contrary to good morals and public order.

Fair Usage Policy

Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd includes all utilities in the nightly rate, however the following fair usage policy will apply for energy usage. This is to ensure that your energy usage is not excessive and stays within reasonable allowances. The allowances are generous and guests are unlikely to exceed these limits if they are sensible with your energy usage.

1. Guests are asked to turn down heating whilst not in the property and to use the thermostats on the radiators. Guests are asked not to open windows whilst the heating is on.

2.Where a booking is for less than 30 nights, these figures will be calculated accordingly for the length of stay. If the guest exceed these limits, Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd reserves the rights to pass the bills on to the guest and or the booker to pay in full or to pay a percentage.

Eagle Owl Property Ltd /Worthing Stays Ltd/Abbey House Worthing Ltd also reserve the right to apply a supplemental charge to cover the amount by which you exceeded the allowances. Eagle Owl Property Ltd and Worthing Stays Ltd also reserves the right to charge additional administration fees and late payment fees as per our terms and conditions. 

Anything above the following usage would classed as excessive: 

1 Bedroom Apartments: £100 pcm (gas)

1 Bedroom Apartments: £100 pcm (electric)

2 Bedroom Apartments: £125 pcm (gas)

2 Bedroom Apartments: £125 pcm (electric)

3 Bedroom House: £150 (electric)

3 Bedroom House: £150 (gas)

4 Bedroom House: £200 (electric)

4 Bedroom House: £200 (electric)

Pets
Are permitted strictly by prior arrangement only.

Pricing
Prices are available on our website and are subject to change without notice, however, your price is guaranteed once you have received confirmation. If you are a business customer we may be able to offer credit terms up to 28 days. Please refer to your invoice.

Right of Entry
Employees of Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd or nominated person shall be allowed access to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

Smoking
Please be advised that all of our properties are non-smoking. Smoking areas are available for you outside of the property. Failure to comply with our non-smoking policy will result in a £150 charge.

Security Statement
If you are booking online, your credit card and booking details are taken through a SSL secure browser connection and the information is directly encrypted by “public key encryption” to a separate computer.

Privacy Statement
Your address and credit card details are kept merely for the informational purposes of the credit card company and the address details are not passed on to any other third parties. Any other information that we keep about you is held and used strictly in accordance with the Data Protection Act 1998 and Eagle Owl Property Ltd/Worthing Stays Ltd/Abbey House Worthing Ltd registration under that Act.

Disclaimer
Use of the staircase to the attic room at Pavilion House is strictly not permitted. The Management/ Eagle Owl Property Limited & Worthing Stays Limited & Abbey House Worthing Ltd will not accept responsibility for any accidents or losses if the attic room is used and any damage to the property will be invoiced to the guests.
